As previously reported, the Legislature has increased the Colorado Governmental Immunity Act tort cap. The new limits are as follows:
- $387,000 for any injury to one person in any single occurrence
- $1,093,000 for any injury to two or more persons in any single occurrence; except that, in such instance, no person may recover in excess of $387,000
In anticipation of the higher limits, the Pool increased the limits of our Public Entity Liability coverage to $2,000,000 last year. However, despite the increases made at no cost to our members, this may not be enough to protect your district from discrimination claims.
These caps do not apply to allegations under federal law, such as allegations of employment, discrimination, or civil rights violations. Due to the current and past awards in litigation against public entities, many districts have been steadily increasing their limits over time.
